Terms of Sale

1. Who we are

Seeus ("Seeus", "the archive", "we", "us") is an independent archive of original digital artworks — posters for imaginary films, broadcasts, recordings, and events that never existed. Seeus is operated from Colombia by two individuals who prefer not to be named publicly; further identifying details are available on request and are provided to consumers and authorities where required by law. 2. Eligibility & acceptance

To purchase, you must be at least 18 years old (or the age of majority where you live) and able to enter a binding contract. By completing checkout for an artifact, you agree to these Terms of Sale as published at the time of your purchase. If you do not agree, please do not purchase.

3. What you are acquiring

Each artifact is a digital product: a high-resolution image file, delivered electronically, together with a certificate of exclusivity. No physical item is sold or shipped. The on-screen preview is a watermarked, reduced-resolution representation; the delivered file is the unwatermarked high-resolution version.

The "certificate of exclusivity" is a record attesting that the artifact was issued to you as a single edition (see §4). It is a record only: it is not a transfer of copyright or title, not a security or financial instrument, and not a promise of any present or future monetary value.

4. Exclusivity

Each artifact is issued once. When you acquire it, it is retired from the archive and marked as claimed. Seeus will not knowingly sell, re-issue, or re-license the same artifact to anyone else. This exclusivity is the core of what you are buying. Provenance — including a SHA-256 fingerprint of the delivered file — is recorded and publicly verifiable at /verify.

The public record at /verify shows only the artifact and its file fingerprint. It does not publish your name, email, or any other personal information.

Exclusivity is a commitment by Seeus regarding future sales of the same artifact. It is not a transfer of copyright (see §6), and it does not prevent others from independently creating similar works.

If we ever issue the same artifact to more than one person in error, your remedy is a full refund of the price you paid for that artifact (see §10). If Seeus ceases to operate, the exclusivity already granted to you is unaffected — your file and certificate remain yours under the license in §6.

5. Provenance & authenticity

Seeus artifacts are original digital works created using digital and generative-AI tools. Delivered files carry embedded provenance metadata, and each sale is fingerprinted for verification. The fiction of the archive is a creative presentation; the authenticity record at /verify is factual.

6. License & intellectual property

To the extent copyright subsists in an artifact, it remains with Seeus. Your purchase grants you a perpetual, worldwide, non-exclusive license to keep, display, and print the file for your own personal, non-commercial use, together with the one-of-one exclusivity commitment described in §4. (Exclusivity refers to how the artifact is issued — once; the license refers to how you may use it.)

Except as expressly permitted in the paragraph below, you may not, without our prior written permission:

• resell, redistribute, sublicense, or share the high-resolution file;
• use the artifact for commercial purposes (including merchandise or resale of prints);
• claim authorship of the artwork.

Private transfer (exception). As a private collector you may make a one-time transfer of the single artifact you acquired to another person, provided you transfer your only copy and keep none. This is a transfer of your one copy and license — not a right to reproduce or distribute. Contact us to record the change of ownership in the provenance log.

7. Payment

Checkout and payment are handled by our payment provider, Gumroad, which acts as the Merchant of Record for your purchase. That means Gumroad is the seller of record for payment and tax purposes and collects applicable sales tax / VAT, while Seeus is the creator and licensor of the artifact; these Terms govern the artifact and your license. Prices are shown in US dollars; your bank or card issuer may apply currency-conversion fees. Your use of checkout is also subject to Gumroad's own terms and privacy policy.

8. Delivery & your right of withdrawal

Artifacts are delivered digitally to the email address used at checkout, normally within 24 hours of a completed purchase. If you have not received your file and certificate within that window, contact us at hello@seeusarchive.art and we will make it right.

Consumers in some countries (including the EU and UK) normally have a 14-day right to withdraw from online purchases. Because an artifact is digital content supplied immediately, this right is lost once delivery begins, where you have consented to that. By completing your purchase and asking to receive your artifact right away, you (a) expressly request and consent to immediate delivery before the end of any statutory withdrawal/cancellation period, and (b) acknowledge that you will lose your right of withdrawal once delivery has begun. We confirm your consent and this acknowledgment in your order-confirmation email. If you do not give this consent, we will hold delivery until any applicable withdrawal period has ended.

9. Refunds

Because each artifact is a one-of-one digital good that is permanently retired from the archive on purchase, and because you consent to immediate delivery (§8), we do not offer refunds for change of mind. If your file fails to deliver, arrives corrupted, or was charged in error, contact us and we will repair delivery, re-send a corrected file, or refund the purchase. We aim to resolve such issues if you contact us within 14 days, but this 14-day window is our goodwill turnaround target — it does not limit any statutory rights you have, which may last longer. Nothing here limits any non-waivable rights you may have under applicable consumer law, or any refund Gumroad issues under its own policies.

10. Disclaimers & liability

Nothing in these terms excludes or limits any liability that cannot be excluded or limited under the law that applies to you — including your statutory consumer guarantees (such as that digital content be of satisfactory quality and as described), and liability for fraud, for death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.

Subject to the paragraph above, and to the fullest extent permitted by law, artifacts are provided "as is," we disclaim other implied warranties, and our total liability arising from any artifact or these terms is limited to the amount you paid for the artifact in question. We are not liable for indirect or consequential losses.

11. Privacy

We process the personal data needed to fulfil your purchase (such as your email and order details, handled with Gumroad). How we handle personal data, your rights, and how to contact us about them are described in our Privacy Policy.

12. Changes

We may update these terms; the version that applies to your purchase is the one published here at the time you buy, with the date shown above.

13. Governing law & disputes

These terms are governed by the laws of Colombia. If you are a consumer, you also keep the benefit of any mandatory consumer protections of your country of residence, and you may be able to bring proceedings in your local courts — nothing here removes that.

If something goes wrong, please contact us first at hello@seeusarchive.art; we genuinely try to resolve issues directly before anything formal.

14. Severability & entire agreement

If any provision of these terms is found unenforceable, the rest remain in effect. These terms, together with the Gumroad terms applicable at checkout and our Privacy Policy, are the entire agreement between you and Seeus about your purchase.
